THIRD-PARTY PRODUCTS, TRADEMARK USE, PRODUCT IMAGES, AND INTELLECTUAL PROPERTY COMPLIANCE POLICY

Celebration Crafters is an independent online retailer of party decorations, balloon décor, celebration kits, seasonal decorations, gifts, and related products sourced from various manufacturers, suppliers, distributors, sellers, marketplaces, and fulfillment partners.

Third-party product names, trademarks, logos, photographs, designs, and other identifying information may be referenced solely to identify, describe, market, or distinguish products offered for sale.

NO BRAND OR MARKETPLACE AFFILIATION

Unless expressly stated otherwise, Celebration Crafters is not manufactured by, sponsored by, endorsed by, approved by, affiliated with, or authorized by any third-party manufacturer, brand, marketplace, retailer, seller, or fulfillment provider.

This includes, without limitation, Amazon and any manufacturers, sellers, or brands whose products may be offered or fulfilled through third-party channels.

All trademarks, trade names, logos, brand identifiers, copyrighted materials, and other intellectual property remain the property of their respective owners.

THIRD-PARTY PRODUCT DISCLOSURE

Celebration Crafters offers products sourced through various retail and commercial channels.

References to third-party brands or products are intended solely to help customers identify and understand the products being offered. Celebration Crafters does not knowingly represent third-party products as being manufactured, sponsored, or endorsed by Celebration Crafters.

Celebration Crafters does not knowingly advertise, distribute, or sell counterfeit products, unauthorized reproductions, or products falsely represented as originating from another party.

PRODUCT IMAGES AND CONTENT

Product photographs, graphics, descriptions, specifications, designs, and other listing materials may originate from manufacturers, suppliers, distributors, licensors, marketplace sellers, fulfillment partners, or other third-party content providers.

Celebration Crafters does not claim ownership of third-party photographs, trademarks, graphics, or other protected materials. Such materials are displayed solely to identify, describe, and market the corresponding products.

Any intellectual-property owner or authorized representative who believes that content has been displayed without proper authorization is encouraged to contact Celebration Crafters so the matter can be reviewed and, where appropriate, the disputed content can be removed, replaced, attributed, or otherwise addressed.

CELEBRATION CRAFTERS INTELLECTUAL PROPERTY

The Celebration Crafters name, logo, original written content, original graphics, website design elements, branding, and other materials created specifically for Celebration Crafters are owned by or licensed to Celebration Crafters.

These materials may not be copied, reproduced, distributed, modified, republished, or used commercially without prior written authorization.

INTELLECTUAL PROPERTY COMPLIANCE

Celebration Crafters maintains procedures intended to promote compliance with applicable copyright, trademark, unfair-competition, and intellectual-property laws.

Celebration Crafters reviews reported product listings, product images, descriptions, brand references, and other website content to reduce the risk of inaccurate representations concerning ownership, product origin, sponsorship, authorization, or affiliation.

Nothing in this policy constitutes an admission that Celebration Crafters is legally required to remove or modify content based solely upon an unsupported allegation.

INTELLECTUAL PROPERTY COMPLAINT PROCEDURE

An intellectual-property owner or authorized representative who believes that content on this website infringes its rights may submit a written complaint containing:

  • Identification of the protected work, trademark, photograph, design, or other intellectual property;
  • The exact URL or sufficient identification of the allegedly infringing content;
  • An explanation of the legal basis for the complaint;
  • The complaining party’s full name and contact information;

REVIEW AND CORRECTIVE ACTION

Upon receiving a sufficiently detailed complaint, Celebration Crafters will conduct a reasonable good-faith review.

Depending on the circumstances, Celebration Crafters may:

  • Request additional documentation;
  • Temporarily restrict or remove disputed content;
  • Replace product photographs or descriptions;
  • Contact the applicable supplier or content provider;
  • Request proof of ownership or licensing;
  • Restore content when a complaint is withdrawn or unsupported; or
  • Take other action considered appropriate.

Removal, modification, or temporary restriction of content does not constitute an admission of infringement, liability, wrongdoing, or lack of authorization.

NOTICE AND OPPORTUNITY TO INVESTIGATE

Celebration Crafters requests that intellectual-property owners, suppliers, marketplaces, processors, financial institutions, and other interested parties provide direct written notice and a reasonable opportunity to investigate and address an alleged violation before pursuing unnecessary adverse action.

This request does not apply when immediate reporting is legally required, required by applicable payment-network standards, or reasonably necessary to prevent imminent fraud or consumer harm.

GOOD-FAITH INVESTIGATION POLICY

Celebration Crafters welcomes good-faith communication from intellectual-property owners, payment processors, acquiring institutions, card networks, marketplaces, advertising platforms, suppliers, hosting providers, regulatory authorities, and other relevant parties.

Celebration Crafters requests sufficient information to:

  • Identify the specific content or transaction at issue;
  • Verify the complainant’s identity and authority;
  • Understand the factual and legal basis of the concern;
  • Investigate the source of the product or content; and
  • Take reasonable corrective action where warranted.

Celebration Crafters may maintain records relating to product sourcing, listings, intellectual-property complaints, correspondence, investigations, and corrective actions.

FALSE, MISLEADING, OR ABUSIVE COMPLAINTS

Celebration Crafters reserves all rights concerning complaints, notices, reports, or allegations that are knowingly false, fabricated, materially misleading, malicious, reckless, submitted without authority, or made for an improper competitive or commercial purpose.

This includes the intentional:

  • Misrepresentation of intellectual-property ownership;
  • Submission of altered or fabricated documentation;
  • Omission of material facts necessary to understand the dispute;
  • Impersonation of a rights holder or authorized representative;
  • Repeated submission of claims already determined to be unsupported;
  • Publication of false allegations to third parties; or
  • Attempt to interfere unlawfully with Celebration Crafters’ business relationships.

Celebration Crafters may request correction, withdrawal, retraction, preservation of evidence, or other appropriate action in response to an unsupported or abusive complaint.

PAYMENT PROCESSOR AND ADVERSE REPORTING POLICY

Celebration Crafters requests that any party considering an adverse report to a payment processor, acquiring bank, card network, marketplace, advertising platform, hosting provider, supplier, search engine, risk-monitoring service, or merchant database provide complete and accurate information.

This includes reports submitted to payment processors, financial institutions, marketplaces, service providers, risk-monitoring databases, or other third-party merchant review and compliance systems.

Where legally and contractually permissible, Celebration Crafters requests:

  • Written notice of the specific allegation;
  • Identification of the reporting party;
  • Disclosure of the factual basis for the report;
  • A reasonable opportunity to provide relevant records;
  • Consideration of corrective action already completed; and
  • Prompt correction or updating of materially inaccurate information.

Nothing in this section restricts truthful good-faith reporting, legally required reporting, regulatory cooperation, fraud prevention, or compliance with applicable card-network and financial-institution requirements.

PRESERVATION OF EVIDENCE

Any party asserting a claim or making an adverse report concerning Celebration Crafters is requested to preserve all relevant evidence, including communications, account records, complaint submissions, screenshots, source files, ownership documents, investigation notes, and reports sent to third parties.

Celebration Crafters similarly reserves the right to preserve records relevant to any complaint, dispute, investigation, termination, adverse designation, or commercial interference.

RESERVATION OF RIGHTS

Celebration Crafters reserves all rights, claims, defenses, remedies, and causes of action available under applicable law and contract.

This reservation includes rights concerning false, fabricated, defamatory, malicious, reckless, unsupported, or materially misleading allegations that cause or threaten harm to Celebration Crafters’:

  • Payment-processing services;
  • Banking or acquiring relationships;
  • Marketplace access;
  • Advertising accounts;
  • Supplier relationships;
  • Website or hosting services;
  • Merchant-risk profile;
  • Commercial reputation; or
  • Lawful business operations.

Where permitted by applicable law, Celebration Crafters may seek correction, retraction, reinstatement, injunctive relief, declaratory relief, monetary damages, costs, attorneys’ fees, or any other available remedy against parties responsible for unlawful conduct.

This policy does not create a cause of action where none otherwise exists and does not limit the contractual or legal rights of payment networks, financial institutions, regulators, marketplaces, or other third parties.

NO ADMISSION OR WAIVER

Nothing in this policy shall be construed as:

  • An admission of infringement, wrongdoing, liability, or unauthorized use;
  • A waiver of any legal or contractual right;
  • Acceptance of an unsupported allegation;
  • Consent to the jurisdiction of any particular court;
  • A promise that any specific content will be removed; or
  • A limitation on Celebration Crafters’ right to dispute a complaint or adverse report.

Celebration Crafters expressly preserves all rights and defenses available under applicable law.
