Welcome to Celebration Crafters. These Terms of Service govern your access to and use of our website, online store, products, services, features, content, and related tools, collectively referred to as the “Services.”

Throughout these Terms, “Celebration Crafters,” “we,” “us,” and “our” refer to Celebration Crafters. “You” and “your” refer to any visitor, customer, purchaser, account holder, or other user of our Services.

By visiting our website, browsing our store, creating an account, placing an order, or otherwise using our Services, you agree to these Terms of Service and any policies incorporated by reference, including our Privacy Policy, Shipping Policy, Return and Refund Policy, Payment Policy, and Intellectual Property Policy.

If you do not agree to these Terms, you should not access or use our Services.

Section 2 — Products and Product Information

Celebration Crafters makes reasonable efforts to display and describe products accurately. However, we do not guarantee that product descriptions, photographs, videos, colors, measurements, quantities, materials, packaging, included components, availability, or other information will always be complete, current, or error-free.

Product appearance may vary because of:

Screen and device settings
Lighting and photography
Manufacturing variations
Supplier or manufacturer updates
Differences between production batches
Natural variations in materials
Packaging revisions

Colors shown in photographs may differ slightly from the physical product.

Product photographs may contain furniture, serving pieces, backdrops, displays, table settings, accessories, or other styling props that are not included unless expressly identified in the product description.

You are responsible for reviewing the complete product description before purchasing.

We may update, correct, discontinue, replace, or limit the availability of a product at any time without prior notice. We may also limit quantities, restrict sales by location, or refuse service where permitted by law.

Section 3 — Assembly, Setup, and Product Use

Certain products may require inflation, assembly, installation, attachment, hanging, or other preparation before use.

Customers are responsible for:

Reviewing and following all instructions and warnings
Confirming that all surfaces and mounting locations are suitable
Using appropriate tools, hooks, fasteners, or supports
Keeping products away from flames, excessive heat, water, electrical hazards, and other unsafe conditions
Properly supervising children and pets
Discontinuing use if a product becomes damaged or unsafe

Do not attach decorations in a way that could damage walls, ceilings, furniture, fixtures, or other property. Celebration Crafters is not responsible for property damage resulting from adhesives, hooks, tape, fasteners, improper installation, or improper removal.

Products must be used only for their intended decorative or celebratory purpose.

Section 4 — Balloons, Small Parts, and Safety

Balloons, balloon accessories, confetti, ribbons, clips, hooks, adhesive dots, and other party products may contain small parts or present choking, suffocation, entanglement, or other hazards.

Adult supervision is required when balloons or small decorative components are used around children.

Uninflated or broken balloons must be kept away from children and discarded promptly. Some balloons may contain natural rubber latex or other materials capable of causing allergic reactions.

Customers are responsible for reviewing product packaging and complying with all manufacturer warnings, age recommendations, instructions, and safety information.

Celebration Crafters does not represent that every product is a toy or is intended for unsupervised use by children.

Section 5 — Third-Party Products and Fulfillment

Celebration Crafters offers products sourced from various manufacturers, suppliers, distributors, sellers, retailers, marketplaces, and fulfillment providers.

Certain orders may be sourced, packed, processed, or shipped by a third-party fulfillment partner. Packages may display the name, packaging, labeling, or branding of the party responsible for fulfilling the shipment.

Products from the same order may arrive in separate packages or on different delivery dates.

Unless expressly stated otherwise, Celebration Crafters is not affiliated with, sponsored by, endorsed by, or an authorized dealer of any third-party brand, manufacturer, marketplace, retailer, or fulfillment provider.

Your purchase is made from Celebration Crafters, and questions regarding your order should be directed to us.

Section 6 — Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An order confirmation acknowledges that we received your order but does not necessarily mean the order has been accepted or shipped.

We reserve the right to accept, reject, cancel, limit, or modify an order for reasons including:

Product unavailability
Inventory discrepancies
Pricing or listing errors
Payment authorization failure
Suspected fraud or unauthorized activity
Shipping restrictions
Duplicate orders
Quantity limitations
Incorrect customer information
Supplier or fulfillment issues

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

Please review your order carefully before submitting it. We cannot guarantee that products, quantities, shipping addresses, or other information can be changed after processing begins.

Section 7 — Pricing, Payment, and Billing

All prices, promotions, discounts, and product availability are subject to change without notice.

The price charged will generally be the price displayed when the order is submitted, unless a pricing, technical, or listing error requires correction.

You agree to provide accurate, complete, and current payment and billing information.

By submitting a payment method, you represent that:

You are authorized to use that payment method
The information provided is accurate
Charges associated with the order will be honored
The transaction is not fraudulent or unauthorized

We may delay or cancel an order if payment cannot be verified or if the transaction is identified as potentially fraudulent or high-risk.

Payment terms are further governed by our Payment Policy.

Section 8 — Taxes

Applicable sales taxes will be calculated and displayed during checkout based on the shipping destination and applicable tax requirements.

You are responsible for any taxes, duties, assessments, or other governmental charges associated with your purchase, except where Celebration Crafters is legally required to collect and remit those amounts.

Section 9 — Promotions and Discount Codes

Promotions, sales, discount codes, free-shipping offers, and other special offers may be subject to additional terms.

Unless expressly stated otherwise:

Promotional offers cannot be combined
Discount codes have no cash value
Promotions may be modified or discontinued at any time
Discounts cannot be applied retroactively
Excluded products may not qualify
Minimum purchase requirements may apply
Only one discount code may be accepted per order

We may cancel or reject any promotion obtained or used through fraud, technical errors, unauthorized distribution, or misuse.

Section 10 — Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

Processing and delivery estimates are provided in good faith but are not guaranteed. Delivery may be affected by carrier disruptions, supplier delays, severe weather, holidays, address problems, high order volume, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and deliverable shipping address.

Additional charges may apply when a package is returned because of:

An incorrect or incomplete address
Refused delivery
Failed delivery attempts
An inaccessible delivery location
Customer failure to retrieve the package

If we cannot ship within the timeframe communicated for an order, we will provide available options in accordance with applicable law.

Celebration Crafters is not responsible for losses caused by a customer entering an incorrect address or failing to secure a delivered package.

Section 11 — Event Dates and Time-Sensitive Purchases

Customers are responsible for ordering sufficiently in advance of their celebration or event.

Delivery estimates are not guarantees that a package will arrive before a particular birthday, wedding, shower, graduation, holiday, or other event unless we expressly provide a written guaranteed-delivery commitment.

We are not responsible for venue charges, replacement purchases, event expenses, lost profits, emotional distress, or other costs resulting from a carrier delay, delivery disruption, or a customer ordering too close to an event date.

This section does not limit any rights that cannot legally be waived.

Section 12 — Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy.

Return requests must be submitted within the return period stated in that policy.

Returned products must meet the applicable eligibility requirements. Products that have been inflated, assembled, used, damaged, altered, personalized, or returned without required components or packaging may be ineligible for return or subject to a reduction reflecting loss in value.

Customers are responsible for return shipping costs unless otherwise stated in our Return and Refund Policy or required by law.

Approved refunds will be issued to the original payment method.

Section 13 — Cancellations

We will attempt to accommodate cancellation requests, but cancellation is not guaranteed once an order has entered processing, been submitted to a supplier, or shipped.

Orders that have already shipped must be handled under our Return and Refund Policy.

We reserve the right to cancel an order before shipment for any lawful reason. If payment has already been collected, an appropriate refund will be issued.

Section 14 — Intellectual Property

Content available through our Services may include website designs, logos, trademarks, photographs, graphics, product descriptions, videos, icons, page layouts, software, and other materials.

Such content may be owned by Celebration Crafters, our licensors, manufacturers, suppliers, content providers, or other third-party rights holders.

You may use our website only for lawful, personal, and noncommercial purposes.

You may not, without authorization:

Copy or reproduce website content
Republish product images or descriptions
Modify, distribute, or sell website materials
Scrape or systematically extract data
Use our trademarks or branding
Create derivative commercial materials
Circumvent technological protections
Misrepresent an association with Celebration Crafters

Third-party trademarks, photographs, product names, designs, and other intellectual property remain the property of their respective owners.

Section 15 — Reviews, Feedback, and Customer Submissions

If you submit a review, photograph, video, comment, suggestion, testimonial, idea, or other content, you grant Celebration Crafters a nonexclusive, worldwide, royalty-free, perpetual, transferable, and sublicensable license to use, reproduce, edit, publish, display, distribute, translate, and promote that content in any format or medium.

You represent that:

You own or control the rights necessary to submit the content
The content is accurate and based on your genuine experience
The content does not infringe another party’s rights
The content does not contain unlawful, defamatory, threatening, obscene, misleading, or harmful material

We may monitor, edit, refuse, or remove submitted content, but we are not required to do so.

Nothing in these Terms prohibits an honest review or legally protected consumer communication.

Section 16 — Third-Party Services and Links

Our website may use or provide access to payment processors, shipping carriers, applications, analytics tools, social media services, embedded content, and links operated by third parties.

We do not control and are not responsible for third-party websites, tools, services, content, security practices, availability, policies, or conduct.

Your use of a third-party service may be governed by that party’s own terms and privacy policy.

Links are provided for convenience and do not necessarily constitute our endorsement of the linked party.

Section 17 — Store Platform

Our online store may be hosted or supported by Shopify and other commerce, payment, security, fraud-prevention, marketing, analytics, and logistics providers.

Information may be processed by these providers as necessary to operate our store, process transactions, prevent fraud, fulfill orders, provide customer support, and maintain the Services.

A purchase from our store is a transaction between you and Celebration Crafters, not between you and the provider hosting the store platform.

Section 18 — Privacy

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy.

By using our Services, you acknowledge that information may be processed by service providers involved in website hosting, payment processing, fraud prevention, analytics, advertising, customer support, and order fulfillment.

Provisions that should reasonably survive termination will remain effective, including provisions concerning payments, intellectual property, submitted content, disclaimers, liability limitations, indemnification, and disputes.

Section 22 — Disclaimer of Warranties

Except where expressly stated in writing, and to the fullest extent permitted by law, the Services and products are provided on an “as is” and “as available” basis.

We do not guarantee that:

The website will always be uninterrupted or error-free
Product colors will appear exactly as shown on every screen
Products will meet every individual preference or expectation
Third-party services will always remain available
Delivery estimates will always be met
Every product will be suitable for every venue, surface, climate, or use

To the fullest extent permitted by law, Celebration Crafters disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, title, durability, and noninfringement.

Manufacturer warranties, if any, are provided by the applicable manufacturer and are subject to that manufacturer’s terms.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

Section 23 — Limitation of Liability

To the fullest extent permitted by law, Celebration Crafters and its owners, employees, contractors, affiliates, suppliers, licensors, service providers, and fulfillment partners will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of the Services or purchase or use of a product.

This includes, without limitation:

Lost revenue or profits
Event expenses
Venue charges
Replacement decorations
Loss of use
Business interruption
Damage caused by improper installation
Damage caused by adhesives or fasteners
Missed event dates
Third-party carrier delays
Loss or corruption of data

To the extent permitted by law, our total aggregate liability arising from a particular product or transaction will not exceed the amount you paid to Celebration Crafters for the product or transaction giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be excluded or limited.

Section 24 — Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Celebration Crafters and its owners, employees, affiliates, contractors, suppliers, licensors, service providers, and fulfillment partners from claims, damages, liabilities, losses, and reasonable expenses arising from:

Your violation of these Terms
Your unlawful use of the Services
Your misuse or unsafe use of a product
Your violation of another party’s rights
Content you submit
Fraudulent or unauthorized activity conducted through your account
Your failure to follow product instructions or safety warnings

We reserve the right to control the defense of a covered claim, and you agree to provide reasonable cooperation.

Section 25 — Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law.

Any unenforceable portion will be severed, and the remaining provisions will continue in effect.

Section 26 — Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

A waiver is effective only when expressly made in writing by an authorized representative of Celebration Crafters.

Section 27 — Entire Agreement

These Terms and the policies incorporated by reference constitute the entire agreement between you and Celebration Crafters regarding the Services and your purchases.

They supersede prior or contemporaneous communications, representations, proposals, or agreements concerning the same subject matter.

Section 28 — Assignment

You may not assign or transfer these Terms or your rights or obligations under them without our written consent.

Celebration Crafters may assign or transfer these Terms, in whole or in part, in connection with a business sale, reorganization, financing, change of control, or transfer of operations.

Section 29 — Governing Law and Venue

These Terms and any separate agreements through which Celebration Crafters provides products or Services will be governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Subject to any rights or venue requirements that cannot legally be waived, disputes arising from these Terms, the Services, or a purchase from Celebration Crafters shall be brought in the appropriate state or federal courts located in or serving Gasconade County, Missouri.

Nothing in this section prevents either party from pursuing a remedy in small-claims court when eligible.

Section 30 — Changes to These Terms

We may update, modify, or replace these Terms by posting an updated version on our website.

The “Last Updated” date will reflect the date of the most recent revision.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
